PRIVACY POLICY

myNext takes the privacy of our guests and the users of our (mobile) applications and our websites very seriously. We treat all the personal data of our guests with great care and we always act in accordance with, and in many cases exceed, the applicable national and international data protection legislation.

This privacy statement describes our privacy practices when you visit and/or use our mobile applications and/or websites that are (co)owned or licensed by myNext, (together: the ‘Websites’), make a reservation at myNext or visit one of our accommodations such as our hostel, apartments, hotels or any other property that belong to myNext. This Privacy Statement describes which personal data are collected from you and for which purposes we process your personal data.

Which personal data do we process and for what purposes?
myNext operates activities in the business of hospitality.

We collect, store and process your personal data at four possible different stages: 1. before you choose to stay at myNext, 2. during your stay at myNext, 3. after your stay at myNext and/or (iv) when you are accessing and using our Websites.

Before you make a booking at myNext:

When you visit the Websites, we collect information anonymously about your use of the Websites. We use this information to provide you with personal offers, both on the Website and on other websites you visit via online and third party advertisements. We may also use this information for remarketing purposes to remind and assist you with potential bookings that were left incomplete.

You can also subscribe to our newsletter by filling in your e-mail address at the Websites. This newsletter contains news and special offers of myNext. If you no longer wish to receive our newsletter, you can use the link provided in every newsletter to unsubscribe.

When you make a reservation as a hotel-,apartment- or hostel-guest:

When you make a reservation as a hotel-,apartment- or hostel-guest at myNext, you will provide us with your name, your (e-mail) address, your home address, your stay preferences, the dates you are staying with us and your payment details. This information will be used and is necessary to process the reservation, for billing purposes and to allow us to communicate with you about your reservation.

When you make a reservation as a semester guest:

When you make a reservation as a semester guest, you will provide us with your name, your home address, place of birth, nationality, ID/passport number, and a copy of the registration of your university. Furthermore, you have to provide us the personal details of your parents and/or guarantor. These details will be used for billing purposes and in case of an emergency.

As soon as you make a reservation as a semester guest you automatically receive a login code to enter the TSH LIFE App and/or our online portal.

After your stay at myNext:

After you left myNext we will store your personal data in a profile. Should you return to myNext someday, we want to be able to offer the best possible service you can imagine, and customize your stay based on your personal preferences.

Who has access to your personal data?
We handle your personal data discreetly and will process the personal data only for our own purposes. We will never sell of give your personal data to third parties without explicit prior consent. We will only transfer your personal data to third parties if it is necessary for us to fulfill our contractual obligations towards you. The third parties we work with are bound by the same conditions toward you and your personal data as written in this privacy statement.

We automatically collect generated information for statistical purposes. This information tells us how well our Websites are functioning. This information may be provided to third parties, but only if this information cannot be traced back to you directly or indirectly.

We may also provide your data to third parties if we are obliged to do so under national or international laws and regulations.

Your rights
Right to information

If you want to know what personal data we have collected and/or processed from you, you can request myNext to provide an overview of your personal data by sending an e-mail to: booking@mynext.at. We will provide you with an overview of your personal data that we collect and/or process. Please state clear in the subject that your request concerns a privacy matter.

Rectification and erasure

If you believe that the personal data that we process is incorrect, inaccurate or incomplete, you may ask us to change or remove such personal data, by sending an e-mail to: booking@mynext.at. In this e-mail you can state your interest in removing (as much as possible) or changing your personal data. Please state clear in the subject that your request concerns a privacy matter. We will reply to your request within 4 weeks.

Withdrawal of consent

When you provided your consent to us to process your personal data, you can withdraw your consent any time, without affecting the lawfulness of processing activities based on your consent before its withdrawal, by sending an e-mail to: booking@mynext.at. If you withdraw your consent, we will no longer process your personal data. Please state clearly in the subject that your request concerns a privacy matter.

How do we protect your personal data?
myNext takes all necessary technical and organizational measures to protect your personal data against loss or any form of unlawful use of any third party. A strictly limited number of people have access to your personal data, and access to your personal data is only granted when explicitly needed to provide our services to you. Additionally, myNext has adopted a “Security First” policy with all 3rd party vendors, software companies, internal staff and contractors, meaning we only select those that share our core beliefs on security and privacy, and take the safety and security of your personal data as seriously as we do.

Analytics services and cookies
myNext uses various analytics services, such as:

Hotjar

These services use cookies to help us analyze how you use the Websites. We have concluded a processor agreement with the providers of these services, in which the obligations of these providers are adopted. We do not share any data with our analytics providers.

We furthermore use cookies that collect information on your surfing behavior. This information may contain personal data. We can use the personal data collected in that way for the purposes as stipulated in this Privacy Statement.

Transfer of personal data to other countries
For many of our business purposes we use cloud based services. Therefore, for technical and organizational reasons, it may be necessary that your personal data is transferred to servers located in the US, or to servers located in other countries outside of the European Economical Area. Since privacy protection regulations in these countries may not be of a sufficient level, we will ensure that your personal data will only be sent to parties and/or countries with an adequate level of personal data protection.

Links to other websites
The Websites may contain links to other websites we do not control. Therefore, we will not be liable for the content of these websites, nor for the processing of personal data that may occur on these websites.

Copyright and other rights of intellectual property rights
The (intellectual) property rights relating to the content and design of the platforms and the Websites of myNext, including but not limited to text, data files, photos and (still and / or moving) images, audio material as well are owned by myNext or its licensors .

Reproduction (including processing) and / or disclosure of content and design of the platforms or the Websites of myNext is prohibited without the prior written consent of myNext.

Adjustments to this privacy statement
myNext reserves the right to make changes to this privacy statement. The most current and applicable version of this privacy statement can always be found on our Websites.

Hotjar

Wir nutzen Hotjar, um die Bedürfnisse unserer Nutzer besser zu verstehen und das Angebot auf dieser Webseite zu optimieren. AGB / Beherbergungsvertrag

I.
Vertragschließende Parteien

Beherberger: LIVE by ÖJAB GmbH, Mittelgasse 16, 1062 Wien
Gast: Ist eine natürliche oder eine juristische Person, die einen Beherbergungsvertrag abschließt.

II.
Vertragsgegenstand

Gegenstand dieses Vertrages ist die Beherbergung des Gastes samt Erbringung von Nebenleistungen entsprechend der vom oder für den Beherberger bestätigten Buchung des Gastes in einem der vom Beherberger betriebenen Beherbergungsbetrieben.

III.
Vertragsdauer

Der Gast hat das Recht, das gebuchte Zimmer ab 15.00 Uhr des Ankunftstages zu beziehen. Das Zimmer ist durch den Gast am Tag der Abreise bis 11.00 Uhr freizumachen. Der Beherberger ist berechtigt, dem Gast die Kosten einer weiteren Übernachtung in Rechnung zu stellen, sollte der Gast das Zimmer nicht fristgerecht freimachen. Reist der Gast vorzeitig ab, so ist der Beherberger berechtigt, das volle vereinbarte Entgelt für die vereinbarte Dauer der Beherbergung zu verlangen.

IV.
Entgelt

Das vom Gast für die Beherbergung zu leistende Entgelt enthält die bei der Buchung vereinbarte und ausgewiesene Rate, inklusive Steuern und Abgaben.

V.
Rücktritt vom Beherbergungsvertrag – „No show“
Rücktritt durch den Gast

Dem Gast steht ein Rücktrittsrecht von dem mit dem Beherberger abgeschlossenen Beherbergungsvertrag nur dann zu, wenn ein solches Rücktrittsrecht anlässlich der Buchung ausdrücklich vereinbart wurde. Es gelten in diesem Fall die bei der Buchung vereinbarten Rücktritts- und Stornobedingungen.

No show
Erscheint der Gast nicht bis Mitternacht des Ankunftstages („no show“), erlischt die Beherbergungspflicht des Beherbergers für die gesamte Dauer des Beherbergungsvertrages und der Beherberger ist berechtigt, für das vom Gast gebuchte Zimmer mit Dritten einen Beherbergungsvertrag abzuschließen, sofern der Gast den Beherberger nicht nachweislich von eine späteren Anreise in Kenntnis gesetzt hat. Der Gast bleibt trotz „no show“ zur Bezahlung des vereinbarten Entgelts für die gesamte Dauer des Beherbergungsvertrages verpflichtet; einen Anspruch auf Minderung des vom Gast geschuldeten Entgelts hat der Gast nur, sofern und soweit der Beherberger über das vom Gast gebuchte Zimmer Beherbergungsverträge mit Dritten abgeschlossen hat.

VI.
Beistellung einer Ersatzunterkunft

Der Beherberger kann dem Gast aus sachlich gerechtfertigten Gründen eine adäquate Ersatzunterkunft (vergleichbare Qualität) zur Verfügung stellen, sollte der Beherberger nicht in der Lage sein, den Beherbergungsvertrag zu erfüllen. Eine sachliche Rechtfertigung ist dann gegeben, wenn das vom Gast gebuchte Zimmer unbenutzbar ist, eine Überbuchung vorliegt oder sonstige wichtige betriebliche Gründe in der Sphäre des Beherbergers dessen Erfüllung des Beherbergungsvertrages entgegenstehen.
Allfällige Mehraufwendungen für das Ersatzquartier trägt Beherbergers.

VII.
Rechte des Gastes

Durch den Abschluss des Beherbergungsvertrages erwirbt der Gast das Recht auf den in vergleichbaren Beherbergungsbetrieben üblichen Gebrauch des Zimmers und der Einrichtungen des Beherbergers, die üblicher Weise und ohne besondere Bedingungen den Gästen allgemein zur Benützung zugänglich sind.

VIII.
Pflichten des Gastes

Der Gast ist verpflichtet, für nicht von der Buchung erfasste Leistungen des Beherbergers, die der Gast in Anspruch genommen hat, spätestens vor der Abreise zu bezahlen.

Der Beherberger ist nicht verpflichtet, Fremdwährung zu akzeptieren.

Der Gast haftet dem Beherberger gegenüber für jeden Schaden, den er oder sonstige Personen, die mit Wissen oder Willen des Gastes Leistungen des Beherbergers entgegennehmen, wie insbesondere Begleitpersonen des Gasts oder vom Gast im Beherbergungsbetrieb empfangene Besucher, verursachen.

Der Verlust eines Schlüssels wird dem Gast mit € 50,- in Rechnung gestellt.

IX.
Zurückbehaltungsrecht

Verweigert der Gast die Bezahlung des geforderten Entgelts oder ist er damit in Rückstand, steht dem Beherberger das gesetzliche Zurückbehaltungsrecht an den vom Gast eingebrachten Sachen zu.

X.
Haftung des Beherbergers

Der Beherberger haftet für die vom Gast eingebrachten Sachen, wenn die Sachen dem Beherberger oder den vom Beherberger befugten Personen übergeben oder an einen von diesen ausgewiesenen oder hierzu bestimmten Ort gebracht worden sind. Der Beherberger haftet für sein eigenes Verschulden oder das Verschulden seiner Leute sowie der im Beherbergungsbetrieb aus- und eingehenden Personen. Der Beherberger haftet höchstens bis zu dem im Bundesgesetz vom 16. November 1921 über die Haftung der Gastwirte und anderer Unternehmer in der jeweils geltenden Fassung festgesetzten Betrag. Kommt der Gast der Aufforderung des Beherbergers, seine Sachen an einem besonderen Aufbewahrungsort zu hinterlegen nicht unverzüglich nach, ist der Beherberger aus jeglicher Haftung befreit. Die Höhe einer allfälligen Haftung des Beherbergers ist maximal mit der Haftpflichtversicherungssumme des Beherbergers, das sind € [Betrag bitte ergänzen] begrenzt. Ein Verschulden des Gastes ist zu berücksichtigen.

Für den Verlust oder die Beschädigung von Kostbarkeiten, Geld und Wertpapiere haftet der Beherberger nur bis zum Betrag von derzeit € 550,00. Der Beherberger haftet für einen darüber hinausgehenden Schaden nur in dem Fall, dass er diese Sachen in Kenntnis ihrer Beschaffenheit zur Aufbewahrung übernommen hat oder in dem Fall, dass der Schaden von ihm selbst oder einen seiner Leute verschuldet wurde. Die Haftungsbeschränkung im vorangehenden Absatz gilt sinngemäß. Die Verwahrung von Kostbarkeiten, Geld und Wertpapieren kann der Beherberger ablehnen, wenn es sich um wesentlich wertvollere Gegenstände handelt, als Gäste des Beherbergers gewöhnlich in Verwahrung geben.

Die Haftungsansprüche erlöschen, wenn der Gast nicht unverzüglich nach Erlangen der Kenntnis vom Verlust, der Zerstörung oder Beschädigung dem Beherberger Anzeige erstattet.

XI.
Haftungsbeschränkungen

Ist der Gast Verbraucher, wird die Haftung des Beherbergers für leichte Fahrlässigkeit, mit Ausnahme von Personenschäden, ausgeschlossen.
Ist der Gast ein Unternehmer, wird die Haftung des Beherbergers für leichte und grobe Fahrlässigkeit ausgeschlossen. In diesem Fall trägt der Gast die Beweislast für den Grad des Verschuldens des Beherbergers. Folgeschäden, immaterielle Schäden oder indirekte Schäden sowie entgangene Gewinne werden vom Beherberger nicht ersetzt. Der zu ersetzende Schaden findet in jedem Fall seine Grenze in der Höhe des Vertrauensinteresses.

Tierhaltung

Das Mitbringen von Tieren ist nicht erlaubt.

XIII.
Gerichtsstand und Rechtswahl

Dieser Vertrag unterliegt österreichischem Recht unter Ausschluss der Regeln des Internationalen Privatrechts sowie UN-Kaufrecht.
Ausschließlicher Gerichtsstand ist im zweiseitigen Unternehmergeschäft Wien.

KEYCARD SYSTEM

Some of our properties have an electronic keycard system. The system is saving a history of opening and closing processes. This is a method for keeping persons and objects safe in our property, only persons of responsibility (the ÖJAB management) has access to this data in case of an incident. This data is going to be deleted 72 hours after recording, except for data that serves as evidence of an incident. There is no monitoring of closing and opening processes. If a keycard gets lost, it is important to immediately contact the reception.

VIDEO SURVEILLANCE

We have camera surveillance in some areas of our properties. These areas are marked. Video surveillance is a method for keeping persons and objects safe in our property, only persons of responsibility (the ÖJAB management) has access to this data in case of an incident. Video recordings are going to be deleted 72 hours after recording, except for recordings that serve as evidence of an incident.
